Like any good business, we have policies with regards to several different things, the biggest one being our license agreement.  In the even that you have purchased an older theme/template, please be aware that the license agreement on this website is the most current and up-to-date and therefore overrides any agreement that came with your theme or template.  It is the user's responsibility to be knowledgeable about the license agreement and other policies of this company.

Template Replacement Policy

Designs by Duchess will happily replace any theme or template within 30 days of purchase.  We do not give refunds, but if you find the template is not working as you expected we would be more than happy to help you solve the problem.  If we have made a mistake in coding the template, we will gladly fix the error and replace the template for you at no cost.

License Agreement

By purchasing and using a theme from Designs by Duchess you agree to the terms of the license included in each theme package, whether you actually read it or not.  For your convenience, I have included the license here for you to read.  Please make sure you have read and understood it before using a theme from Designs by Duchess.

This License Agreement supercedes any previous License Agreement that may be included with older themes.  Please make sure that you have read this latest version of the agreement.

You should carefully read the following terms and conditions before using this theme and/or accompanying templates.

Your use of the theme indicates your acceptance of the terms of this License Agreement. Diane Schlichting, et al grants you the following license:

• You may only use this theme on one website, whether it is your own or for a client.  That includes any and all pages within that site.   If you wish to use it for more than one client it must be repurchased for each subsequent client. Use of this theme on more than one computer is prohibited without prior written consent. 
• You may not transfer this theme to any other user, either group or individual, without the permission of Designs by Duchess.
• You may not store this theme on a server and offer it for sale or resale.  You may not include this theme on a cd or web collection of themes without prior written consent.  This is illegal and is prosecutable under the current laws of Canada and the United States.
• You may not use the thumbnail graphics included on my site (www.designsbyduchess.com) or any other site that promotes my themes without direct permission from Designs by Duchess. Subsequently, you may not link to the working samples of my themes for promotional purposes or any other purposes without permission.
• You may use the theme graphics in a single application, free from copyright infringement. If the main graphical image used in the template is accompanied by a copyright symbol or message, this symbol or message may not be removed from the image.
• Some random graphical elements within the theme and/or template may have been watermarked using the Digimarc technology. This in no way affects the appearance or performance of your theme or template. However, it does allow us to occasionally search and thus find instances where the images are misused. If you have any questions regarding the Digimarc process, please contact us for details.
• Your theme and template package may contain elements that rely on additional third-party software that must be purchased separately in order for said element to be modified or perform satisfactorily on your computer. Such notices are clearly marked on each preview. Elements which rely on such additional software may be removed and not affect the overall performance of the theme and template package.
• No user may alter the appearance of these graphics except to add their own personal or business information on banners, buttons or backgrounds, or to exchange the main graphical image to one better suited for your purposes. Changing images or modifying the theme is at the sole risk of the user and Designs by Duchess does not guarantee the performance of any altered theme package.
• You may not, in any fashion or media, reproduce any of these licensed graphics individually for offering to other parties, either individually or in a collection, whether for free or for fee except as is customary in web site design or for promotional items.

This theme is offered in good faith. The purchaser agrees to not hold Designs by Duchess liable for any loss of revenue, time, or other damages that might be incurred, directly or indirectly, through the use of any FrontPage theme.

In a nutshell: Web Designers can use a theme and template package to create a web site for a client. If the client is going to maintain his own site, he will of course need the package on his own computer. If you (the designer) want to use the theme and template package again, you must repurchase the theme from Designs by Duchess.  You may not sell any theme that you buy from Designs by Duchess or any of its resellers, such as Classy Themes.
